Town of Palmyra 1826

 

Margin Notation:  March 9,1826. Palmyra, March 8th, 1826.  A description of the stray sheep that have been among my sheep ever since sometime in November last:  One large short-tailed ewe with a half crop in the underside of the left ear with a slit in the other half and a crop on the right ear with a half-penny on the underside of the same ear.  One small short-tailed ewe with a half penny on the upper side of the left ear.  One small short-tailed weather without any ear mark on him.     Luman Harrison

 

Margin Notation:  Recorded March 21, 1826.  We, the commissioners of Highways for the Town of Palmyra, do assign Ambrose Hall to Road District No. 2 there to be assessed and taxed on the highway in which he resides.  March 21st, 1826.

Margin Notation:  Recorded March 21, 1826.  Application having been made to the Commissioners of Highways of the Town of Palmyra, County of Wayne, for the discontinuance of the highway commencing at the corner of Thomas Rogers’ fruit garden running east through his land towards Joshua Harry’s so far as it runs through said land of said Rogers and it appears to said commissioners by the authority of freeholders of the said town to have become useless and unnecessary, and the said commissioners having jointly inquired into the matter and it being advised by the undersigned two of the commissioners upon such inquiry that the portion of the road above described is useless and unnecessary, we do adjudge that the person be and hereby is discontinued so far as is above mentioned.  Dated:  March 21st, 1826.

Margin Notation:  March 24th, 1826.  Record of the survey of a road commencing at the town line, where the road leading from David Swezey’s saw mill intersects the said town line near the dwelling house of William Rowley, south 8 degrees, east 56 rods, thence south 14 degrees, east 38 rods, thence south 9 degrees, east 16 rods, thence south 13 degrees, east 62 rods to the west line of Lot No. 6, thence south between Lots No. 6 and 7, 83 rods, thence south 10 degrees, east 44 rods, thence south 19 degrees, east 28 rods, thence south 14 degrees, east 50 rods, thence south 27 degrees, east 24 rods, thence south 33 degrees, east 44 rods, thence south 39 degrees, east 24 rods, thence south 37 degrees, east 46 rods, thence south 45 degrees, east 28 rods, where it will intersect the west line of  land owned by Warren Hopkins.  Palmyra, March 23rd, 1826.

Margin Notation:  Recorded March 24, 1826.  Record of the survey of a road commencing at the town line at the northwest corner of Walter Sherwood’s land and at the northeast corner of Alva Sherwood’s land south 3 degrees, west 32 chains and 87 links to the land of Bela Morgan, thence south 5 degrees, west 25 chains and to the land said Morgan, thence south 18 chains and 6 links on the line of land between George F. Sickles and Thomas Reynier to the road running east and west by the said Sickles and Reynier.  Palmyra, March 23, 1826.

Margin Notation:  Recorded March 25, 1826.  Notice put up April 18, 1826.  Survey of the alteration of a road leading from the Town of Williamson to Palmyra commencing in the center of said road 4 rods and 23 links north of a small river (?) near Pardon Willcox’s dwelling home, thence south 44 degrees, west 20 rods, thence south 10 degrees, west 24 rods, thence north 28 rods, thence south 2 degrees, east 28 rods, thence south 2 degrees, west 44 rods, thence south 2 degrees, east 40 rods, thence south 38 rods, thence south 16 degrees, east 32 rods to the center of the first above mentioned highway.  Dated:  Palmyra, March 25, 1826.

At the annual town meeting held at the meeting house near Stephen Sherman’s land in the Town of Palmyra on Tuesday, april 4th, 1826, present:  Frederick Smith, Abraham Salisbury, and Alexander R. Tiffany, Justices of the Peace of said town and Inspectors of said meeting.

 

Voted that this meeting adjourn to Stephen Sherman’s.  Made recommendation to adjournment.

Voted that Stephen Sherman serve as Supervisor the year ensuing.

 

Voted that Martin W. Willcox serve as Town Clerk the year ensuing.

 

Voted that Nathaniel N. Beckwith, William Willcox, and Ambrose Salisbury serve as Assessors the year ensuing.

 

Voted that Oliver Clark and Hiram foster serve as Overseers of the Poor the year ensuing.

 

Voted that George Culver, Alexander McIntyre, and Truman Heminway serve as Commissioners of Highways.

 

Voted that Ambrose Green, Alexander R. Tiffany, and Lovell Hurd(?) serve as Commissioners of Common Schools.

 

Voted that Daniel L. Douglas, Cullen Foster, and Maltby Clark serve as Inspectors of Common Schools the year ensuing.

 

Voted that William R. Corwin, Cullen Foster, Truman Heminway, and Daniel Hendee serves as Constables the ensuing year.

 

Voted that the Collector have but 3% for his fees of collection.

 

Voted that Truman Heminway serve as Collector for the year ensuing.

 

Voted that the following persons serve as Overseers of Highways for the said district for which they are elected:

Voted that Commissioners and Inspectors of Common Schools be allowed $.75 per day for their services.

 

Voted that the Supervisor procure a correct map of the town to be made, and the expense to be paid out of the contingent moneys of the town. 

 

Voted that Alexander R. Tiffany pay over to the supervisor $100, which is in his hand and that it be for contingent money of the town.

 

Voted that the sum of $200 be raised for the purpose of building a bridge across Mud Creek near to and east of Barnhart’s Mill over which the Turnpike Road passes.

 

Voted that whenever the Turnpike Company executes a bond to the supervisor of the Town of Palmyra conditioned that no gate shall be hereafter created, placed, or put upon said Turnpike Road within the Town of Palmyra, aforesaid, that the said Supervisor shall build or cause to be built with the money raised for that purpose a permanent and suitable bridge at the place above mentioned and that the Town of Palmyra shall keep the same in repair.

 

Voted that this meeting adjourn to meet again on the first Tuesday of April next at 10:00 a.m. at the Presbyterian Meeting House in the Village of Palmyra.

Margin Notation:  Recorded April 24th, 1826.  We, the Commissioners of Common Schools of the Town of Palmyra, County of Wayne, upon application to us for that purpose and with consent of the respective trustees of School Districts No. 4 and No. 21 in said Town of Palmyra, to hereby annex to said District No. 21 all that part of said District No. 4 bounded by and included within the following lines:  Beginning at the northeast corner of the lot on which Daniel Jagger now resides running thence south on the east line of said Jagger’s lot to the south line of Gideon Sherman’s land, thence east to the east line of Seth Howell’s land, thence north on said Howell’s line to the town line of Manchester, thence west on said town line to the northwest corner of Ephraim C. Crow’s land, thence to the place of beginning.  Given under our hands at Palmyra on April 15th, 1826.

To the Honorable Jacob W. Hallett, Jonathan Boynton, and William Gibson, Esquires, three of the Judges of the Common Pleas of the County of Wayne, the appeal of Sebeus Hammond of Palmyra in the County of Wayne, aforesaid from the decision of the Commissioners of Highways of the Town of Palmyra, aforesaid in discontinuing a certain road in the said town as follows:  Commencing at the corner of Thomas Rogers I’s garden running thence east through his (the said Thomas Rogers l) land toward Joshua Stacey’’s so far as it runs through said land of said Rogers, and your appellant considering himself aggrieved by the determination of the said commissioners in discontinuing the said road as above described, to appeal from such determination, praying your honors to convene as soon as may be convenient and decide such appeal according to the form of the statute in such case made and provided.  Dated April 14, 1826.

The judges named in the above petition of appeal, having been on and viewed the road above mentioned and having reviewed the proceedings of the Commissioners of Highways of the Town of Palmyra aforesaid in discontinuing the road mentioned in the above petition and having heard the proofs and allegations of the respective  parties interested therein, we the undersigned, being two the above named judges and to whom the above appeal has been made, do hereby adjudge and determine that the said appellant, Sebeus Hammond, is aggrieved by the decision of the said Commissioners of Highways of Palmyra aforesaid in discontinuing the said road, and we do hereby order, adjudge, and determine that the proceeding of the Commissioners of Highways of Palmyra, aforesaid in discontinuing the said road be and the same are hereby reversed pursuant to the statute in that case made and provided.  This 24th day of April, 1826, at Palmyra aforesaid.            William Gibson and Jonathan Boynton

To the Honorable Jacob W. Hallett, William Gibson, and Jonathan Boynton—Judges of the county of Wayne:  the petition of the undersigned freeholders of the town of Palmyra and county aforesaid respectfully submit that a road has been lately surveyed by the commissioners of Highways of the town of Palmyra leading from the town of Williamson to the village of Palmyra, commencing near Pardon Willcox’s dwelling house and running south on the west side of the hill and west of the old road until it intersects the said old road near the northeast corner of H. Miller’s orchard as more fully appears by the survey of said road.  By means of which said new road, the old road between the dwelling house of said Willcox’s and the northeast corner of said Miller’s orchard has become wholly useless and unnecessary, and the new road when worked will be every way sufficient for the accommodation of the public.  Your petitioners therefore pray that the old road from the points above mentioned be discontinued.  Dated April 24th, 1826.

I certify that on April 24th, 1826, the several persons whose names are subscribed to the foregoing petition appeared before me and made oath that the several statements therein set forth were true.

We, the undersigned Judges of the Court of Common Pleas of the County of Wayne, to whom the within petition is directed and delivered having due proof that the old road within mentioned was established by three of the Judges of the court of common Pleas of the county of Ontario, previous to the erection of the county of Wayne, and having been on and viewed the said old road and do believe that the same has become useless and unnecessary by the laying out of the new road within mentioned, and we do in pursuance of the act in that case made and provided, hereby order the said old road to be discontinued as soon as the said new road shall be opened and made palpable.  Dated at Palmyra, April 24, 1826.              J. Sickles east and west, commencing in the center of the highway passing Benjamin Cole’s north and south at the corner of Joshua Cole’s and Caleb Avery’s land, thence west 3 degrees, north on the line between said lands 38 rods, where it intersects the road as now traveled on said line as by old survey recorded on page ---.

Record of the survey of the alteration of the highway running east from Caleb Avery’s to Pultneyville Road, commencing in the center of the highway passing said Avery’s north and south at the corner of Marquis and Calestia Cole’s lands, thence east 3 degrees, south on the line of said lands 88 rods, where it intersects the road as per old survey recorded on page --.  May 28th, 1826.

Margin Notation:  This road outlawed, and one laid by the Trustees in 1841 nearly the same.

 

A record of the survey of a road 4 rods wide in the village of Palmyra laid out by the Commissioners of Roads of the Town of Palmyra by the consent of all interested as follows, to wit:  Beginning on the north line of Main Street in said village at a red cedar stake, stones, and bricks 12 rods and 6 links west of Asa Lilly on the north side of said Main Street, running thence north 2 degrees, east 44 rods to the south side of the Erie Canal.  The above line is the center of said road hereby laid out and established June 23, 1826.  The above road is hereby annexed to Road District No. 1.

The undersigned Commissioners of Common Schools of the Town of Palmyra, do hereby annex to School District No. 5 in said town all of those lots owned and occupied by Caleb Beals, except 50 acres to be taken from the south end of said lots by a line to be drawn parallel with the south line and so far distant there from as to contain 50 acres.  Given under hands at Palmyra, June 29th, 1826.

Survey of the alteration of the highway  passing Benjamin Hopkins’ dwelling house (as per old survey, now Warren Hopkins) commences at a stake and a quantity of stones imbedded on the line separating Warren Hopkins’ premises from Daniel Jagger at the termination of the center survey of the road passing Daniel Jaggers’ dwelling house, thence south 36 ½ degrees, east 110 rods, and 23 links for the center of said highway to a stake and stones imbedded standing on the line separating Lewis Kent’s  premises from said Warren Hopkins.  The center of the old road as per old survey, said alteration is laid 4 rods wide.  Palmyra, August 16th, 1826.

We, the Commissioners of Highways for the Town of Palmyra, do hereby discontinue so much of the road leading north 2 degrees, east from George Willcox’s as commences 102 rods from the center of the turnpike north, thence north 33 degrees, east 24 rods, thence north 38 degrees, east 20  rods, thence north 2 degrees, west 12 rods, thence north 34 degrees, west 42 rods, where it intersects the road leading north 2 degrees, east to S. Clark’s.  (Original record on page 181, May 10th, 1814; alteration on page 260, July 20, 1824.)

Record of the survey of the alteration of the public highway commencing in the center of the highway as per old survey near the south side of the west end of the Howell Mill Dam at a quantity of brick imbedded three feet deep, thence west 2 degrees, north 76 rods to Isaac Howell’s west line, thence west 3 degrees, north 36 rods, thence west 24 degrees, north 30 rods, near the east line of the Todd farm, thence west 27 degrees, north 102 rods to the center of the highway 2 rods south of the southwest corner of the Goodale lot to near the east end of H. Jessup’s sawmill dam, thence west 30 degrees, north 26 rods as per survey of May 14th, 1806, page 115 to Main Street.  All other surveys of said road are hereby declared void.  May 17th, 1826.

Record of the survey of the alteration of a public highway commencing in the center of the highway leading south from S. Harrison’s mill on the west line of James Galloway’s original farm (now A. Galloway and S. Harrison’s) 5 rods south of S. Harrison’s corner, thence west 37 degrees, south 100 rods to the center of the highway on the bank of the creek, as per old survey, thence west where the road is now traveled.  All other surveys of said road are hereby declared void.  Said line runs for the south line.  May 17th, 1826.
